I would like to demolish an existing home on my property so that I can rebuild. Will I still need a demolition permit?

Yes. The city of New Orleans requires that you have a demolition permit even if you have plans to rebuild on the property in the future.

My property was damaged by a fire and I would like to demolish it. Will I need a permit in order to do so?

In New Orleans, if a property or structure is in danger of a collapse or damaged by a fire, it is your responsibility to have it demolished as soon as possible, as long as a building inspector has conducted a site inspection to verify that the property does indeed pose a threat to others.

This is one of few special circumstances when a permit is not required for demolition.

How much does a demolition permit cost?

As of 2013, the fees associated with a demolition permit are as follows:

  • Demolition permit: $95 base fee + an additional $5 per every $1000 of the total demolition cost
  • Neighborhood Conservation District Committee review (required for certain demolition jobs): $250 for residential buildings and structures and $500 for all commercial buildings and structures or multi-family units
  • Certificate of Appropriateness (required for certain demolition jobs): a 50% surcharge will be added to the base permit cost

Note: If the demolition was started prior to a demolition permit being obtained, a 500% penalty surcharge will also be applied.

Louisiana Demolition Rules and Tips

When demolishing a home or other structure in the state of Louisiana, there are a variety of forms that may need to be filled out depending on your specific project, and there are different rules that apply, too.

For example, if your demolition project contains “Regulated Asbestos Containing Material”, there are going to be different forms and specific precautions you need to take in order to receive the necessary permits.

If your structure does not contain what is considered RACM…

You will need to fill out an AAC-2(b) form, and you will only need to complete the Negative Demolition Sections noted by an asterisk *. This includes Sections I, II, III, IV, V (if applicable), VI, VIII, X, XVI, XVII, and XVIII.

Any non-RACM debris can be disposed of in a designated Construction and Demolition (C&D) Debris landfill or a Type 1 or 2 landfill that is allowed to accept that kind of waste.


If your structure does contain what is considered RACM…

You must complete all sections of the AAC-2(a) form and either mail or hand deliver it to the Department //address is located at the top of the form// no less than 10 business days prior to the scheduled date of RACM removal.

Once the Department receives proper notification that there is RACM on the property, they will issue an Asbestos Disposal Verification Form (ADVF), which gives written permission that you may begin renovation. Throughout the abatement and demolition process, the ADVF must be posted and visible.

NOTE: Ensure you fill out the most up-to-date AAC-2 form, and type it out properly, with an original signature. It also must be accompanied by the designated fee, or it will not be considered a valid notification.
