Does the city of Cherry Hill require a permit?
Yes. According to the state of New Jersey's permitting website, a permit is required for all demolition, alteration, and construction projects taking place in the state of New Jersey. However, there are a few noted exceptions:
A permit is not required for any minor or ordinary repair to any property or structure as defined by NJAC 5:23-2.7 and NJAC 5:23-2.17A.
A permit is not required for emergency work that does not involve lead or any other hazardous materials. However, in the case of an emergency demolition or construction project, you will need to still apply for a permit as soon as you can (no later than 3 days after the work begins).
Whose job is it to obtain the permit?
According to the state's Uniform Construction Code, the permit application must be made by the property owner. If the property owner is not available to do so, then an agent or contractor working on their behalf would also be acceptable.
However, if someone other than the property owner files the application for a permit, an affidavit stating that the work has been authorized by the property owner must be included.
